The LMS antitrust team assists its clients in antitrust proceedings before the European Commission, the Autorità Garante della Concorrenza e del Mercato (the Italian competition authority), and other national competition authorities outside of Italy with the assistance of local counsel.
Members of the team have acted on more than 100 phase-I and more than 20 phase-II merger cases before the European Commission, the Italian competition authority, and other competition authorities around the world.
They have acted on more than 100 cases before the EU General Court and the Court of Justice as well as on cartel cases before the European Commission and the Italian competition authority, including one of the first leniency cases in Italy.
They have a strong track record in abuses of dominance and regulated sectors, having advised on cases relating to predation, retroactive rebates, margin squeeze, refusal to supply, essential facilities, excessive prices, and tying.
The team also advises on horizontal and vertical agreements such as joint-ventures and distribution contracts and is experienced in designing and implementing compliance programmes and carrying out internal audits.
The team has vast experience in contentious matters, including not only public law litigation in actions for the annulment of decisions of competition authorities and regulators but also in private enforcement.
Many members of the team are experienced litigators and advocates and regularly advise and represent clients in complex litigation and arbitrations and act as arbitrators in Italy and abroad.
